Understanding the DOT SAP Evaluation Process

If you’ve failed or refused a DOT-regulated drug or alcohol test, the Federal Motor Carrier Safety Administration (FMCSA) requires that you complete the Return-to-Duty (RTD) process with a qualified Substance Abuse Professional (SAP) before you can resume safety-sensitive duties.

Here’s what the process looks like:

  1. Registration in the FMCSA Clearinghouse
    You must register at the FMCSA Clearinghouse to authorize your employer and SAP to report your progress. This is mandatory for CDL drivers and employers.

  2. SAP Initial Evaluation
    Schedule a virtual or in-person evaluation with a DOT-qualified SAP. The SAP will assess your history, current use, and recommend an appropriate education and/or treatment plan tailored to your needs.

  3. Compliance with SAP Recommendations
    You must complete the recommended treatment or education program (e.g., counseling sessions, drug education classes). The SAP will not approve your return until this is successfully completed.

  4. SAP Follow-Up Evaluation
    After completing your program, you will meet with the SAP again. If compliant, the SAP will update your status in the Clearinghouse, marking you eligible for Return-to-Duty testing.

  5. Return-to-Duty Test
    Your employer will schedule a DOT return-to-duty drug and/or alcohol test. A negative result is required before returning to safety-sensitive work.

  6. Follow-Up Testing Plan
    Once you return to duty, your employer must follow the SAP’s written plan for unannounced follow-up tests (minimum of 6 over 12 months, but can extend up to 5 years).
